SAI Mobile Application Terms of Use

Welcome to the SAI mobile application ("App")! These Terms of Use ("Terms") govern your use of the App and related services offered by SAI ("We", "Us", "Our"). By downloading, installing, accessing, or using the App, you signify that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and us regarding your use of the App and our services. By using the App, you agree to these Terms. If you do not agree to these Terms, you are not authorized to use the App.

2. Changes to Terms

We may modify these Terms from time to time at our sole discretion. When we make material changes to the Terms, we will notify you through the App or by other means (e.g., email, if available). Your continued use of the App after the revised Terms become effective means that you accept those changes.

3. Privacy Policy

Your privacy is important to us. Our Privacy Policy, which explains how we collect, use, and disclose your personal data, can be found at Privacy Policy Link. By using the App, you consent to the collection and use of your data as set forth in our Privacy Policy.

4. User Accounts and Identity

Account Creation: To access premium features like subscriptions and in-app credit purchases, you can create an account using one of the following methods:

• Apple ID (Sign in with Apple)
• Google Account (Sign in with Google)
• Email address with password

Account Responsibility: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security.

Account Deletion: You may delete your account at any time by navigating to Settings > Profile > Delete Account within the App. When you delete your account:

• Your personal data will be permanently removed from our systems
• All unused credits will be forfeited and cannot be refunded
• Active subscriptions will continue until the end of the current billing period
• Created videos may be retained for a limited time for legal compliance purposes

Third-Party Authentication: When using Apple ID or Google Account to sign in, you acknowledge that your authentication is governed by Apple's or Google's respective terms of service and privacy policies. We only receive necessary information to create and maintain your account.

5. Subscriptions and In-App Credits

SAI offers subscriptions and an in-app credit system for its video creation services.

5.1. Subscriptions

• Subscription Types: We may offer various subscription plans with different features and video creation capacities. Details of the subscription plans will be specified within the App.
• Billing: Subscriptions are billed on a recurring basis (e.g., weekly or annually) according to your chosen plan. The initial payment is made on the date your subscription begins.
• Automatic Renewal: All subscriptions automatically renew unless otherwise specified. You must cancel auto-renewal at least 24 hours before the end of your current subscription period through your App Store account settings.
• Cancellation: You can cancel your subscription at any time through your App Store account settings. The cancellation will take effect at the end of the current billing period. No refunds are provided for canceled subscriptions.

5.2. In-App Credits

• Credit Purchase: You can purchase credits within the App to be used for video creation. The prices and quantities of credit packages will be specified within the App.
• Usage: Credits are used for video creation services within the App. The amount of credits required for a specific video creation operation will be clearly stated in the App.
• Expiration: Purchased credits may have an expiration date. The expiration date will be indicated within the App or at the time of purchase. Expired credits cannot be used and are non-refundable.
• No Refunds: Purchased credits are non-refundable under any circumstances. Unused credits are not refunded.
• Changes to Credit Value: We reserve the right to change the value of credits or the amount of credits required for a specific video creation operation with prior notice.

5.3. Payment Transactions

Payment transactions are processed through Apple App Store and Google Play Store payment systems. We do not directly store your payment information. For any issues related to payment transactions, please contact the respective app store support.

Account Portability: Your purchases and subscriptions are tied to your account and can be accessed across different devices when you sign in with the same account credentials.

6. Service Description

SAI is a mobile application that uses artificial intelligence technologies to enable users to create videos from text, images, or other inputs. The App can generate videos in various styles and formats based on the user's input.

7. User Content

• Content Ownership: All texts, images, videos, and other materials that you upload, create, or otherwise provide through the App ("User Content") belong to you.
• License Grant: By using the App, you grant us and our affiliates a worldwide, non-exclusive, royalty-free, sublicenseable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content for the purpose of operating, developing, promoting, and providing our App and services. This license will remain valid even after you stop using the App, if your User Content is part of other works created through the App or if it is necessary to fulfill our legal obligations.
• Prohibited Content: You may not upload, create, or share User Content of the following types:
  • Content that is unlawful, harmful, threatening, abusive, defamatory, obscene, pornographic, libelous, hateful, or racially, ethnically, or otherwise objectionable.
  • Content that infringes the intellectual property rights (copyright, trademark, patent, trade secret, etc.) or other proprietary rights of third parties.
  • Content that impersonates or misrepresents any person or entity.
  • Content that contains viruses, Trojan horses, worms, time bombs, or other harmful computer code, files, or programs.
  • Content that violates any law or regulation.
• Content Moderation: We reserve the right to monitor User Content and to remove or disable access to any content that we, in our sole discretion, believe violates these Terms. However, we are not obligated to pre-screen User Content.

8. Intellectual Property Rights

• SAI Intellectual Property: The App and all its content, features, and functionality (including all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by SAI, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
• User Content Intellectual Property: The intellectual property rights to videos you create through the App belong to you, subject to the license rights stated in these Terms. However, the underlying algorithms, models, and interfaces provided by the App remain the property of SAI.
• Copyright Infringement Claims: If you believe your copyright has been infringed, please notify us at [Contact Email Address Here]. We take infringement claims seriously and respond in accordance with the Digital Millennium Copyright Act (DMCA) and other applicable intellectual property laws.

9. Prohibited Conduct

When using the App, you must not engage in the following conduct:

• Violating any law or regulation.
• Infringing upon or violating the rights of others.
• Disrupting the security or integrity of the App.
• Attempting to reverse engineer, extract source code from, or imitate the App.
• Using the App for unauthorized commercial purposes.
• Uploading viruses or malicious code to the App.
• Engaging in any action that negatively affects the performance of the App.

10. Disclaimer

The App is provided on an "as is" and "as available" basis. SAI makes no warranties that the App will be uninterrupted, error-free, or secure. SAI disclaims all warranties, express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall SAI, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the App.

12. Indemnification

You agree to defend, indemnify, and hold harmless SAI, its directors, employees, partners, agents, suppliers, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your use of the App or your breach of these Terms.

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, at our sole discretion, if you breach these Terms. Upon termination, your right to use the App will immediately cease.

14. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of Adana, Turkey, without regard to its conflict of law provisions.

Any dispute or claim arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Adana, Turkey.

15. App Store Specific Terms

15.1. Apple App Store Terms

These Terms are concluded solely between you and SAI, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.

• Scope of License: The license granted to you for the App is a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the App Store Terms of Service.
• Maintenance and Support: SAI is solely responsible for providing any maintenance and support services with respect to the App. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
• Warranty: In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
• Product Claims: SAI is responsible for addressing any claims by you or any third party relating to the App or your possession and use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
• Intellectual Property Rights: In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Apple will not be responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
• Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-Party Terms: You must comply with applicable third-party terms of agreement when using the App.
• Apple Third-Party Beneficiary: You and SAI acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

15.2. Google Play Store Terms

If you download the App from Google Play Store, you acknowledge and agree that:

• Your use of the App is subject to Google Play's Terms of Service and Content Policy.
• Google is not responsible for the App or its content, and has no obligation to provide maintenance or support services.
• Any claims related to the App should be directed to SAI, not Google.
• Google Play's refund policy applies to any purchases made through the Google Play Store.
